Welcome to Worksheet.ws. Worksheet.ws ("we", "our", or "us", operated by Doubek Industries s.r.o.) provides this service (the "Service") subject to the following terms and conditions ("Terms"). By accessing or using the Service, you agree to be bound by these Terms. If you do not agree with any part of these Terms, please refrain from using the Service.

1. Access to the Service

Access to the Service is granted to users upon registration. Users may access the Service under different subscription plans, including Free, Lite, or Pro, subject to the respective limitations and pricing as specified in the application or on our website. If not agreed otherwise in a separate written agreement, these Terms apply.

The creation of multiple accounts by a single individual, or any other attempt to exploit the Service, is strictly prohibited and may lead to the closure of offending accounts.

2. Compliance with Regulations

The Service is designed to comply with relevant educational regulations, including the Family Educational Rights and Privacy Act ("FERPA"), the Children’s Online Privacy Protection Act ("COPPA"), and the Protection of Pupil Rights Amendment ("PPRA"). By using the Service, you confirm that any data you provide or manage in the Service is handled in compliance with these regulations.

If you are an educator accessing or using the Service on behalf of an educational institution, you represent and warrant that you have the authority to enter into these Terms on behalf of your institution. If you provide access to students under the age of 13, you represent and warrant that you have the necessary permissions to allow us to collect personal information from those students in compliance with COPPA. You are also responsible for providing any required notices to parents or legal guardians and obtaining their consent where applicable.

3. Prohibited Use

You agree not to use the Service for any unlawful or prohibited purposes. This includes, but is not limited to:

Posting, uploading, or sharing any content that is inappropriate, offensive, defamatory, or discriminatory.
Engaging in any activity that involves sexual content, harassment, or exploitation of any kind.
Uploading or sharing content that infringes on the intellectual property rights of others.
Attempting to gain unauthorized access to the Service or any related systems or networks.
Engaging in activities that may harm or disrupt the Service or other users' experience.

Violation of these prohibitions may result in immediate suspension or termination of your account.

4. Reporting Violations

If you become aware of any misuse of the Service, including violations of the prohibited use policy, please contact us at support@worksheet.ws. We take such matters seriously and will take appropriate action, which may include account suspension or termination.

5. Data Privacy

We value your privacy. The Service is committed to complying with applicable data protection laws, including but not limited to the General Data Protection Regulation ("GDPR"), the UK GDPR, FERPA, COPPA, and PPRA.

Regardless of the user's jurisdiction, we extend the rights granted under the GDPR to all our users, including but not limited to:

The right to request data deletion.
The right to object to or restrict processing of your personal information.

If not agreed differently in a separate written agreement, these data privacy rights apply to all users of the Service.

6. Warranty Disclaimer and Limitation of Liability

Due to the inherent complexity of generative artificial intelligence, Worksheet.ws and its licensors or suppliers do not guarantee the accuracy, reliability, or quality of any content generated by or accessed through the Service. THE SERVICE AND CONTENT ARE PROVIDED BY WORKSHEET.WS (AND ITS LICENSORS AND SUPPLIERS) ON AN "AS-IS" BASIS, WITHOUT ANY WARRANTIES, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, OR THAT THE SERVICE WILL OPERATE WITHOUT INTERRUPTION OR BE ERROR-FREE. SOME JURISDICTIONS MAY NOT ALLOW LIMITATIONS ON IMPLIED WARRANTIES, SO SOME OF THESE LIMITATIONS MAY NOT APPLY TO YOU.

To the fullest extent permitted by applicable law, under no circumstances shall Worksheet.ws (or its licensors or suppliers) be liable to you or any other person for (a) any indirect, incidental, special, or consequential damages, including but not limited to lost profits, loss of goodwill, lost time, or loss of data, or (b) any damages in excess of the greater of (i) $100 or (ii) the total amount paid by you to Worksheet.ws in connection with the Service during the twelve (12) months preceding the claim. SOME JURISDICTIONS DO NOT ALLOW THE EXCLUSION OR LIMITATION OF CERTAIN DAMAGES, SO SOME OF THESE LIMITATIONS MAY NOT APPLY TO YOU.

7. Self-Registered Customers and Custom Agreements

These Terms apply to all users unless agreed differently in a custom, written agreement between you and us. For customers with specific requirements or enterprise needs, separate agreements may modify or supersede these standard Terms.

8. Refund Policy

You may request a full refund within 7 days of purchase. To initiate a refund, please contact us at support@worksheet.ws.

9. Updates to the Terms

We reserve the right to update or modify these Terms from time to time. Users will be notified of any updates via email. Continued use of the Service following such changes indicates your acceptance of the new Terms.
